1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the Harborstone Management website and any resident or owner portal made available through it. By accessing or using these services, you agree to these Terms. If you do not agree, please do not use the site or portal.

These Terms do not replace or modify the management agreement between Harborstone Management, LLC and any association or property owner, or the governing documents of any community association. Where a conflict exists, the signed management agreement and the association's governing documents control.

2. Management Services

Information presented on this website is for general informational purposes only. Nothing on this site constitutes legal, tax, accounting, investment, or insurance advice, and nothing on this site creates a management relationship.

Descriptions of services, fees, and timelines are illustrative. Actual scope, fees, and service levels are set out only in a signed management agreement or proposal. Although we work to keep site content current, service details and availability may change without notice.

3. Portal Accounts

Where a portal is provided, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information, to notify us promptly of any unauthorized use, and not to share access with anyone who is not entitled to it.

We may suspend or terminate portal access where we reasonably believe access has been misused, shared improperly, or used in violation of these Terms or applicable law.

4. Acceptable Use

You agree not to:

• Use the site or portal for any unlawful purpose or in violation of these Terms.
• Attempt to access accounts, records, or systems you are not authorized to access.
• Interfere with or disrupt the site, portal, or the servers and networks that support them.
• Use automated means to scrape, harvest, or index content or data without written permission.

7. Limitation of Liability

To the fullest extent permitted by law, Harborstone Management, LLC and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the website or portal. Our total liability for any claim relating to the website or portal will not exceed one hundred dollars ($100).

Nothing in these Terms limits any liability that cannot be limited under applicable law, or any obligation under a separate signed management agreement.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of the site or portal will be brought in the state or federal courts located in Marin County, California, and each party consents to venue there.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce a provision is not a waiver of it.
